The agreement
These Terms of Service ("Terms") are an agreement between [Registered company name]("Jess", "we", "us") and the business or person that creates an account or uses the service ("you"). If you accept them on behalf of a business, you confirm you're authorised to bind it.
Jess is built for businesses, not consumers. You must be at least 18 to use it. Our Privacy Policy explains how we handle personal data and forms part of these Terms.
The service
Jess is an AI receptionist. Depending on your setup, it answers phone calls and messages for your business, answers customer questions using the information you give it, gives quotes based on the rules you set, books jobs into your calendar, saves caller details, sends summaries to you, and sends reminders, follow-ups and review requests to your customers.
Features may vary by plan and region, and some depend on third-party services you connect.
Your account
Give us accurate information and keep it up to date. You're responsible for your account, everyone you invite to it, and everything done under it — keep your login details secure and tell us straight away at[email protected] if you think someone has accessed it without permission.
Plans and billing
The standard plan costs USD 99 per monthand includes 250 call minutes. Extra minutes are billed atUSD 0.40 per minute, in arrears, with the next monthly invoice.
- Subscriptions renew automatically each month until cancelled.
- Unused minutes don't roll over to the next month.
- Prices exclude taxes, which we'll add where required. Your phone carrier may also charge you for forwarding calls to Jess.
- If a payment fails, we'll let you know and may pause the service until it's settled.
- We may change prices with at least 30 days' notice. The new price applies from your next billing period; you can cancel before then if you don't agree.
- Fees already paid are non-refundable, except where the law says otherwise.
Your responsibilities
You're in control of how Jess talks to your customers, so you're responsible for:
- The information you give it — services, prices, hours, service areas and policies. Jess passes on what you set up; keep it accurate.
- Recording and AI disclosure — configuring your greeting so callers are told they're speaking with an AI and that the call may be recorded, and getting any consent the law requires where you and your callers are.
- Messages to your customers — having the consent required (for example, under the TCPA, CAN-SPAM or local equivalents) before Jess sends reminders, follow-ups, review requests or marketing on your behalf, and honouring opt-outs.
- Your customers' data — having a lawful basis to collect it, giving them any privacy notices required, and handling their requests. We process it on your behalf, as described in our Privacy Policy.
- The jobs themselves — Jess books work; you're responsible for the quotes, the work, and your relationship with your customers.
Not an emergency service
Jess is not an emergency service and can't contact emergency services. If a caller describes a situation that puts people or property at risk — a gas leak, electrical fire, flooding — Jess can take a message and alert you, but it can't guarantee that you'll see it in time. Set up your greeting and call-transfer rules so that urgent callers are told to contact emergency services directly.
Acceptable use
Don't use Jess, or let anyone else use it, to:
- break any law, or infringe anyone's rights;
- make unsolicited calls or send spam, robocalls or messages without the required consent;
- impersonate a person or business, or mislead callers about who they're talking to;
- collect sensitive data you don't need, such as full payment card numbers, health information or government ID numbers, through a call;
- interfere with the service, get around its limits or security, or reverse-engineer it except where the law allows;
- resell the service or build a competing product from it without our written agreement.
We may suspend accounts that break these rules, or that put our service, our carriers or other customers at risk.
Your data
You own your data — your business setup, your customer records, and the recordings, transcripts and messages from your calls ("Customer Data"). You give us permission to use it only to provide, secure and support Jess, and to improve it as described in our Privacy Policy.
You can export or delete your Customer Data from your account, or ask us to. If you need a data processing agreement, email[email protected].
Third-party services
Jess works with services we don't control — phone carriers, messaging apps, calendars and other integrations. Your use of them is governed by their own terms, and we're not responsible for their availability or for changes they make that affect how Jess works with them.
Intellectual property
We own Jess — the software, the voice, the brand and everything we build — and we give you a limited, non-exclusive, non-transferable right to use it during your subscription. If you send us feedback or ideas, we're free to use them without any obligation to you.
AI output
Jess uses AI to understand callers and respond to them. It's good at this, but it can mishear, misunderstand or get things wrong. Review your call summaries and bookings, and don't rely on Jess for anything where a mistake would cause serious harm. The quotes and commitments made to your customers are yours.
Availability and changes
We work to keep Jess answering 24/7, but we can't promise it will never be interrupted — for maintenance, carrier outages or events beyond our control. We may improve, change or remove features over time; if a change significantly reduces what you're paying for, we'll tell you in advance and you can cancel.
Cancellation and termination
You can cancel anytime from your account or by emailing[email protected]. Cancellation takes effect at the end of the current billing period, and any overage minutes already used are still due.
We may suspend or end your account if you seriously or repeatedly break these Terms, don't pay, or if we have to by law. Where it's reasonable, we'll warn you first and give you time to fix the problem. After your account ends, you'll have 30 days to export your data before we delete it as described in ourPrivacy Policy.
Disclaimers
To the extent the law allows, Jess is provided "as is" and "as available". We don't make any warranties beyond those written in these Terms — including implied warranties of merchantability, fitness for a particular purpose and non-infringement — and we don't guarantee any particular number of calls answered, jobs booked or business results.
Limitation of liability
To the extent the law allows, neither of us is liable to the other for indirect, incidental, special or consequential losses, or for lost profits, revenue, business or data — including jobs missed or booked incorrectly.
Our total liability for all claims relating to Jess is limited to the fees you paid us in the 12 months before the event that caused the claim.
Nothing in these Terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.
Indemnity
You'll defend and compensate us for claims, losses and costs (including reasonable legal fees) brought by third parties that arise from your Customer Data, the messages sent on your behalf, your breach of these Terms, or your failure to get the consents described above.
Governing law
These Terms are governed by the laws of [State / country], and any dispute will be handled by the courts there — unless the law where you're based gives you the right to bring a claim locally.
General
- Changes to these Terms — we'll post updates here and change the date at the top. For significant changes, we'll give account holders at least 30 days' notice by email or in the app. Continuing to use Jess after that means you accept them.
- Assignment — you can't transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
- Whole agreement — these Terms, the Privacy Policy and any order or agreement we sign with you are the entire agreement between us.
- Severability and waiver — if part of these Terms can't be enforced, the rest still applies. Not enforcing a right straight away doesn't mean we've given it up.
